These Terms and Conditions govern your participation in the Tapo Rewards Program (“Program”) operated by TP-Link Systems, Inc. By participating in the Program, you agree to these Terms and the TP-Link Website Terms of Use (collectively, the “Terms”), and the TP-Link Privacy Policy.
IMPORTANT NOTICE REGARDING DISPUTE RESOLUTION:
BY ACCEPTING THESE TERMS, YOU AGREE THAT ANY DISPUTES ARISING OUT OF OR RELATING TO THE PROGRAM WILL BE RESOLVED THROUGH BINDING ARBITRATION OR SMALL CLAIMS COURT AS DESCRIBED IN SECTION 12 AND YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR JURY TRIAL.
1. Program Overview.
The Tapo Rewards Program allows participants to earn rewards points (“Points”) for making qualifying purchases in the official TP-Link Tapo Store located at us.store.tp-link.com (the “Store”) based on the participant’s Rewards Tier (defined below) and participating in activities or other opportunities that may be presented by TP-Link from time to time. Subject to these Terms, Points may be redeemed for Rewards (as defined below), which may include discounts and select products. For clarification, purchases made through third-party retailers are not qualifying purchases and will not earn Points.
There is no fee associated with participating in the Program. Participation is personal and non-transferable. Points and Rewards Tiers may not be gifted, sold, or otherwise transferred. Points have no cash value, are not redeemable for cash, and do not constitute the property of any participant. No portion of any payment for purchases qualifying for the Program or any Points, Rewards Tier, or Rewards constitutes consideration paid for any of the foregoing. TP-Link reserves the right to limit the redemption of specific Rewards and limit the number of Points and Rewards available.
2. Eligibility and Enrollment.
Participation in the Program is open to all customers of the Store, including guests without a Store account, residing in the United States that are at least 18 years of age. Points may be earned before account creation. However, a valid Store Account (“Store Account”) is required to access, view, and redeem Points or Rewards.
Your Store Account includes your Tapo Rewards account (“Rewards Account”). Your Rewards Account is accessible through your Store Account and reflects your Points balance, Rewards history, and Rewards Tier. You must be signed-in to your Store Account to view or redeem any Points or Rewards.
You are responsible for maintaining the confidentiality of your Store Account credentials and for all activities conducted under your account. TP-Link is not liable for unauthorized access or misuse of your account.
If you violate these Terms or engage in any fraud or abuse in use of the Program, TP-Link may terminate your Rewards Account, bar you from future participation in the Program, and cancel any unredeemed Points, Rewards, and other benefits.
Rewards Accounts cannot be combined or consolidated across multiple Store Accounts.
3. Earning Points.
a. Points are earned for qualifying purchases in the Store based on Rewards Tier as follows:
- Smart Tier: 10 Points per $1 spent
- Pro Tier: 12 Points per $1 spent
- Guru Tier: 15 Points per $1 spent
Points are awarded only for completed qualifying purchases. Points will not be awarded on returned, canceled, or refunded purchases, or on purchases made using excluded discounts or promotional offers. If you return an item or cancel an order, the Points earned from that purchase will be reversed. Points will also be deducted in the event of partial refunds due to price adjustments. In such cases, your Rewards Tier status will be adjusted accordingly. Any misuse of Points through repeated returns or cancellations may lead to restrictions on your account.
b. Points may also be earned for non-purchase related activities, including:
- Email subscription: 300 Points
- Social media follows: 50 Points per platform
- Product reviews: 100 Points per review
From time to time, TP-Link may present other opportunities to earn Points. Points will be awarded as described in the opportunity and subject to any additional terms required by TP-Link. TP-Link has no obligation to provide you with any particular number of Point-earning opportunities.
c. Points are automatically tracked at the time of the qualifying purchase or activity. Points for a single qualifying purchase or activity may only be credited to one Rewards Account. Points will be credited upon completion of the qualifying transaction or activity. It may take at least 24 hours for Points to be credited. TP-Link will not be responsible for, or liable to you, in any way for any losses, costs, or expenses incurred by a delay or error in crediting Points to your Rewards Account. Available Point totals will be displayed in your Rewards account.
4. Redeeming Points.
Points can be redeemed for available Rewards in the Rewards Hub found on the My Account page or at checkout when signed into your Store account. Points may be redeemed for coupons, select products, or other rewards made available through the Program (“Rewards”). In any single redemption transaction, only one Rewards Account may be used to redeem Points for Rewards. Points accrued by you in any purchase or transaction may only be redeemed for Rewards in a separate, subsequent purchase or transaction. Reward availability is subject to change.
You must have at least enough available Points in your account for the Reward you wish to redeem. Points will be subtracted from your account when a Reward is requested based on the total Points for the requested Reward. Rewards can only be redeemed through the Store and cannot be redeemed through any third-party retailer. Coupon Rewards cannot be combined with order-level discounts but may be combined with product-level discounts. Once Points are used to redeem a Reward, the Points will be removed from your account. Points will not be added back to your account if you do not use a Reward before it expires.
Shipping costs may apply to Reward redemptions and free product Rewards. Rewards redeemed for orders under $50 are subject to standard shipping fees.
Determinations regarding redemption of Points are subject to TP-Link’s discretion.
5. Points and Tier Expiration.
Points expire 12 months from the date of your last activity, including purchases, redemptions, or other eligible Point-earning activities. Unredeemed Points that expire are forfeited and will be removed from your account. Any activity during the 12-month period extends the expiration date by an additional 12 months from the most recent activity.
6. Tiers and Benefits.
You will be assigned a tier status: Smart, Pro, and Guru (“Rewards Tier”) based on the number of Points that you earn each Rewards Year from your qualifying purchases and participation in eligible activities during the Rewards Year. The Rewards Year is the calendar year, beginning January 1 and ending on December 31 each year.
Eligibility and benefits are determined by Points accumulated:
- Smart: 0–3,999 Points
- Pro: 4,000–7,999 Points
- Guru: 8,000+ Points
Once your reach a certain Rewards Tier status, you will retain that status for the remainder of the current Rewards Year and the following Rewards Year. Rewards Tier status is determined annually, and you must meet the requirements for a particular Rewards Tier status each Rewards Year, or your status will reset based on the number of Points you earned during that year. Points from one Rewards Year do not roll over to a subsequent Rewards Year for purposes of determining Rewards Tier. TP-Link reserves the right to change, modify, or update the number of Points or other actions and requirements needed to earn each Rewards Tier status and any benefits or bonuses associated with a Rewards Tier.
7. Referrals.
When you refer a customer that makes a qualifying purchase of $100, you will receive $15 off your next qualifying order. Referral Rewards are void if the referral results from fraudulent activity, multiple accounts, or violations of these Terms.
8. Cancellation by You.
You may opt-out of the Program at any time, by notifying TP-Link Tapo Shop support at support.shopus@tp-link.com. If you cancel your Rewards account, any unredeemed Points, Rewards, and/or progress towards a Rewards Tier will automatically be cancelled and will no longer be available for redemption. Upon re-enrollment, your status will start at the lowest Tier. TP-Link reserves the right to suspend or terminate, at TP-Link’s sole and absolute discretion, any TP-Link account if TP-Link believes that the account holder has violated or acted inconsistently with these Terms or applicable law or otherwise acted in a manner harmful to TP-Link’s interests.
Upon cancellation or termination for any reason, your Rewards account shall immediately cease, and you will no longer receive Points or Rewards. TP-Link has no obligation to and shall not compensate you for any unredeemed Points, Rewards, or other benefits of the Program following cancellation.
9. Modification and Termination.
TP-Link reserves the right to change, modify or terminate the Program, or any or all benefits under the Program, or any policy pertaining to the Program, at any time, for any reason, including the right to discontinue or change the Rewards Tiers or change the expiration date or redemption value of Points or Rewards, merge the Program with another program, or to adjust how Points or Rewards are received, calculated or redeemed.
If TP-Link elects to terminate or modify, in a material way, the Program or any benefits or policies of the Program, TP-Link will provide notice by posting the modifications or notice of termination to the Store. TP-Link may also attempt to notify you in other ways. Any modifications will become effective immediately after such posting or other such notification. You are encouraged to review these Terms regularly for modifications. In the event of such termination, at TP-Link’s election, TP-Link may allow you to redeem any outstanding valid and unexpired Points or Rewards until expiration of such Points or Rewards. ANY UNREDEEMED AND UNEXPIRED POINTS OR REWARDS SHALL BE CANCELLED AT THE LATER OF (1) THE EXPIRATION OF THE THEN-CURRENT REWARDS OR (2) NINETY (90) DAYS AFTER PROGRAM TERMINATION.
10. Privacy and Data Usage
Participation in the Tapo Rewards Program involves the collection and processing of personal information, such as account details, purchase history, and Program activity. TP-Link uses this information to administer and improve the Program and to communicate with you about rewards, offers and updates. By participating in the Program, you may receive promotional or transactional emails related to your Rewards, Points balance, and special offers. You can opt out of promotional emails at any time by following the unsubscribe instructions in the footer of our emails. However, you may still receive transactional and Program-related notices. Participation in the Program is subject to TP-Link’s Privacy Policy, which provides more information regarding how your personal data is collected, used, and protected. By joining and participating in the Program, you acknowledge and agree to the terms of that Policy.
11. Limitation of Liability.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROGRAM, POINTS, REWARDS, AND ALL RELATED SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
TP-LINK, ITS AFFILIATES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE PROGRAM OR THESE TERMS, EVEN IF TP-LINK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE FOREGOING, TP-LINK SHALL NOT BE LIABLE FOR ANY DAMAGES OR LOSSES RESULTING FROM (A) THE USE OF OR INABILITY TO USE OR ACCESS THE PROGRAM; (B_ TECHNICAL FAILURES OR ERRORS; (C) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR ACCOUNT OR ACCOUNT DATA; OR (D) ANY OTHER MATTER RELATING TO THE PROGRAM. IN NO EVENT SHALL TP-LINK’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE PROGRAM EXCEED THE GREATER OF (1) THE TOTAL VALUE OF REWARDS REDEEMED BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM OR (2) ONE HUNDRED US DOLLARS ($100).
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU TO THE EXTENT PROHIBITED BY LAW.
12. Governing Law and Dispute Resolution.
These Terms and any disputes or claims arising from or relating to the Program, these Terms, or your participation are governed by and construed in accordance with the laws of the State of California, without regard to its conflicts of law principles.
In the event of a dispute or claim, you agree to first contact TP-Link Tapo Shop support at support.shopus@tp-link.com to attempt to resolve the issue informally. You must provide enough information for us to attempt to resolve your dispute or claim, including (a) your name; (b) the email address associated with your Rewards Account; and (c) a written description of the problem, relevant documents, and supporting information. You and TP-Link agree to negotiate any dispute in good faith for a 60-day period. You further agree that you will not commence any legal proceeding unless this informal process has been completed in good faith.
IF WE ARE UNABLE TO RESOLVE THE DISPUTE OR CLAIM WITHIN 60 DAYS DESPITE GOOD FAITH EFFORTS, YOU AND TP-LINK AGREE THAT ANY AND ALL CONTROVERSIES OR CLAIMS OF ANY NATURE, INCLUDING TORT AND STATUTORY CLAIMS, ARISING OUT OF OR RELATING TO THESE TERMS OR THE PROGRAM SHALL BE SETTLED BY INDIVIDUAL BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION (“AAA”) BY A SOLE ARBITRATOR IN ACCORDANCE WITH ITS CONSUMER ARBITRATION RULES THEN IN EFFECT OR IN SMALL CLAIMS COURT.
Arbitration shall take place in Orange County, California, unless you and TP-Link agree otherwise or the AAA Consumer Rules require a different location or remote hearing. Each party shall bear its own attorneys’ fees and costs except as required by law. Payment of all filing, administration, and arbitrator fees will be governed by the AAA Consumer Rules. The arbitrator’s decision shall be final and binding and judgment on the award may be entered in any court of competent jurisdiction.
CLASS ACTION AND JURY TRIAL WAIVER. YOU AND TP-LINK EACH AGREE THAT ANY DISPUTE WILL BE RESOLVED ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU AND TP-LINK EACH FURTHER AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL.
13. Miscellaneous.
These Terms constitute the entire agreement between you and TP-Link concerning the Program and supersede all prior representations or agreements. If any provision of these Terms is found unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect. The provisions relating to limitation of liability, dispute resolution, governing law, and class action waiver shall survive termination of the Program or your participation.
